UNDERSTANDING

The following is an abbreviated and informal version of Enviro Cleaning Co’s more formal version of their “Terms & Conditions” of service. For complete and detailed Terms & Conditions, please see the document titled, “TERMS & CONDITIONS OF SERVICE BY ENVIRO CLEANING CO – THE NITTY GRITTY” following this abbreviated version. HOW WE CHARGE FOR OUR SERVICES (Time Charged vs Time at Premises)

Enviro Cleaning Co works in teams of 2 people. When we quote a job, we will quote you for the total amount of time needed for 1 person to complete the job. This makes it clearer for the client to understand how much cleaning needs to (and will) be done. E.g. If your premises required 2 hours’ worth of cleaning done, this means that our cleaners would be at your premises for 1 hour, with each cleaner doing 1 hours’ work, totalling 2 hours of cleaning done. 

 

SERVICES PROVIDED

Enviro Cleaning Co offers 3 different service categories for commercial clients;

1.) “One-Off” clean

2.) “Weekly” clean, and

3.) “Daily” clean

(other cleaning schedules may be negotiated depending on booking availability)

PAYMENT FOR SERVICE

Enviro Cleaning Co accepts 2 methods of payment;

1.) Direct Deposit (from your Credit Card, Savings Card or “Pay ID” via internet banking)

2.) Cash

The following instructions detail the terms of payment for “One Off” and “Weekly” cleans.

Unfortunately, in the past we have encountered some rather unethical clients who have thought that it is O.K not to pay us after we have provided them with an outstanding service and we have been forced to leave their very clean and sparkly premises without being paid. So, in order to know that we are going to be paid for the great service we will provide you with, and organise our next day’s work, we require to know that we have received your payment no later than 24 hours before your scheduled service. As we all know, sometimes technology (more precisely, its failings) or the stresses of life can get in the way of paying for things electronically or online, so for these reasons we ask that you attempt to make your full payment for your requested cleaning service at least 48 hours out from your scheduled service. This way, if there is a technological problem or you have just forgotten to make the payment on time, it gives you plenty of time to sort out whatever the problem is to allow you to have your payment received by us by the 24-hour deadline. Also, don’t forget, if you are paying by the “Direct Deposit” method that it can sometimes take several days for the funds to be seen in the other (our) account so you might want to deposit your fees a few days out from the 24-hour deadline, just to be sure. And, if you are paying by trusty old CASH, we ask that you have the full fee ready, and as close to the right money as possible as we only carry a very small amount of change with us (because we only have a very small car!). NOTE TO SELF!: If I’m paying by Direct Debit and I haven’t ensured that my payment to Enviro Cleaning Co will reach their account by no later than 24 hours out from my scheduled service (they will let me know), they will cancel my service. Also, if I’m paying by cash, I must ensure that I have the full amount ready for Enviro Cleaning Co, otherwise they will cancel my service and I might have to pay for their wasted time and petrol, DOH!!

The following instructions detail the terms of payment for on-going “Daily” cleans.

Because we are more familiar with you and you have proven to be a reliable, regular client we have relaxed the payment protocol for you which will also help with your cash flow. For regular, ongoing daily cleans we will invoice you at the end of the working week (usually either a Friday or Saturday) by e-mail. We will give you 5 business days to have the full fees for the invoiced service cleared into our account. Also, don’t forget, if you are paying by the “Direct Deposit” method that it can sometimes take several days for the funds to be seen in the other (our) account so you might want to deposit your fees around the 2nd day of the 5- day window. Should your payment not be cleared into our account by the 5th day we will contact you to see if we can sort something out with you.

 

CANCELLING A SERVICE

If you need to cancel a booked-service for whatever reason, we require at least 24 hours’ notice by either e-mail or phone so as we can re-organise our work schedule and so that we can book in another client in your place. We understand that “Life Happens” and you can’t always give as much notice as we would like, so we give you x2 “Freebies” each year to cancel our services up to within an hour of your scheduled service, without charging you for loss of potential business or travel time and costs. We think you’ll agree that this is pretty fair. If you have already paid for your booked-service by Direct Deposit, AND you have given at least 24 hours’ notice of the cancellation of service, we will refund the full amount to the account from which the payment was made, within 48 hours of notification of cancellation. If you need to cancel a service, we will always try to reschedule the service for another time in the same week as the original scheduled service.

 

LOSS OF AND/OR DAMAGE TO A CLIENT’S BUSINESS OR PERSONAL PROPERTY

Although Enviro Cleaning Co will always take absolute care when cleaning your premises, there may be a time when an accident occurs resulting in the inadvertent damage to or breakage of your business or personal property. If this happens, we will make a report of the incident and inform you as soon as is practicable of what has happened. We will work with you to determine the most appropriate course of action which will remedy the situation. If we are totally liable, we will totally pay for it. We don’t want our customers disadvantaged just because they decided to have their premises cleaned.

 

QUALITY ASSURANCE & SATISFACTION GUARANTEE

At the end of each service, our team members check each other’s work against a Quality Assurance check list to ensure every task has been completed, and at the highest quality. If something is not right, the responsible team member will fix the problem. Once both team members are satisfied that the service has been completed and at the highest quality, they will both sign off a Quality Assurance check list which will be e-mailed to you within 24 hours of completion of the service (Technology and Telco services permitting).

 

If for some reason you are not satisfied with an element of our service, please tell us while we are still at your premises (if possible) and we will endeavour to rectify the problem straight away. If you are not present while we service your premises but you return to your premises to find something about our service that is less than acceptable, please phone us within 24 hours of completion of the service with full details of the complaint and we will return to your premises to rectify the problem as soon as we can, free of charge.

UNDERSTANDING

By placing a tick in the tick-box against “I have read, understood and agree to the Terms & Conditions”, you are agreeing to be bound by the following Terms & Conditions of service provided by Enviro Cleaning Co.

 

Definitions

 

CLIENT: A person or persons, or a business who/which engages Enviro Cleaning Co to carry out a cleaning service in or on their premises for a fee.

 

A BUSINESS: An entity or group or organisation which is carrying on a commercial enterprise providing goods and/or services which is “for-profit” in a commercial dwelling or premises.

 

ENVIRO CLEANING CO: The name of the entity and business offering the advertised cleaning services on this website in accordance with the Terms & Conditions below.

 

OUR: Represents a reference to Enviro Cleaning Co.

 

YOU: Represents a reference to any “Client”.

 

SERVICE: Is the provision of cleaning tasks performed by Enviro Cleaning Co in accordance with the selected and submitted “order form” within this website by domestic clients, or, as quoted for commercial clients, in accordance with the Terms & Conditions below.  

 

DOMESTIC: Represents a private, non-commercial household residing in a non-commercial dwelling.

 

COMMERCIAL: Represents an entity or group or organisation which is carrying on a business or enterprise providing goods and/or services which is “for-profit”, in a commercial dwelling or premises.

 

NON-PROFIT: Represents an entity or group or organisation which is carrying on a business or enterprise providing goods and/or services which is “not-for-profit”, in a commercial dwelling or premises.

 

INDIRECT CAUSE: A situation or circumstance whereby Enviro Cleaning Co were proven NOT to be the direct and only cause of damage or breakage or loss of a client’s property as a result of an incident during a cleaning service performed by Enviro Cleaning Co, but where the client has been found to have an amount of responsibility and/or liability towards the circumstances and conditions which led to the damage or breakage or loss of a client’s property during a cleaning service performed by Enviro Cleaning Co.

 

DIRECT CAUSE: A situation or circumstance whereby Enviro Cleaning Co were proven to be the direct and only cause of damage or breakage or loss of a client’s property as a result of an incident during a cleaning service performed by Enviro Cleaning Co.

The following instructions detail the terms of payment for “One Off” and “Weekly” cleans (and any other negotiated schedule)

 

1.) If paying by Credit Card: For the client to be able to pay by Credit Card, the only way this is facilitated until further notice is by the client using Internet Banking and transferring the full service fee to Enviro Cleaning Co’s nominated bank account from the client’s Credit Card account. From this point on, as this is the same process as conducting a “Direct Deposit”, the entire contents of Point “2.) If paying by Direct Deposit:” directly below will apply.

2.) If paying by Direct Deposit: Client’s must ensure to allow for sufficient time for funds for the total fee of the service to be received into our nominated account at least 48 hours prior to the scheduled provision of service. This may mean that the funds for the full fee for the service may need to be deposited into our nominated account up to several days before the 48 hours prior to the scheduled provision of service. If the full fee is not received into our nominated account at least 48 hours prior to the scheduled provision of service for whatever reason, the client will be notified of the situation as soon as possible by Enviro Cleaning Co by either e-mail or phone and given the opportunity to investigate and/or rectify the situation. If the client attempts to investigate and/or rectify the situation (within 24 hours of being notified that funds to cover the full fee for service have not been cleared in our account) and receives confirmation from their financial institution that the problem is as a consequence of a problem at the client’s financial institution’s end, and the client immediately relays this information to Enviro Cleaning Co by either e-mail or phone, Enviro Cleaning Co may then make other arrangements for payment or give further instructions of what to do. In this instance, Enviro Cleaning Co will not cancel the scheduled service.

 

If it is proven that the problem of the full fee not having been received into our nominated account at least 48 hours prior to the scheduled provision of service is as a consequence of a problem at Enviro Cleaning Co’s financial institution’s end, Enviro Cleaning Co will make other arrangements for payment or give further instructions of what to do. In this instance, Enviro Cleaning Co will not cancel the scheduled service.

 

If the full fee for the service is not available in Enviro Cleaning Co’s nominated account within 24 hours of the client being notified of the full fee for service not being received into our nominated account by the specified time, as a result of the client not having allowed sufficient time for the funds to clear in our account, or did not deposit the correct and full amount for the service, then Enviro Cleaning Co reserves the right to cancel the service immediately and without any further notification.

 

3.) If paying by cash: If paying by cash, the total fee for the service is to be paid to an Enviro Cleaning Co team member prior to the commencement of service when Enviro Cleaning Co arrives at your premises. A Tax Invoice will be e-mailed to the client within 24 hours of completion of the service. If the client does not have the full amount for the service in cash, part payment of the service will not be accepted, and Credit Card or Direct Deposit cannot be accepted in this situation. If full payment is not received prior to commencement of the service, Enviro Cleaning Co will cancel the service immediately and without any further notification. If Enviro Cleaning Co cancels a service due to non-payment prior to commencement of the service, a $50 call-out fee may be charged to compensate for travel time and fuel and road costs (Tolls).

 

The following instructions detail the terms of payment for on-going “Daily” cleans.

For regular, ongoing daily cleans we will invoice the client at the end of the working week (usually either a Friday or Saturday) by e-mail. We will give the client five (5) business days to have the full fees for the invoiced service cleared into our account, or to pay in cash to an Enviro Cleaning Co team member on arrival to the client’s premises within the five (5) business days window for payment.

 

1.) If paying by Credit Card: For the client to be able to pay by Credit Card, the only way this is facilitated until further notice is by the client using Internet Banking and transferring the full service fee to Enviro Cleaning Co’s nominated bank account from the client’s Credit Card account. From this point on, as this is the same process as conducting a “Direct Deposit”, the entire contents of Point “2.) If paying by Direct Deposit:” directly below will apply.

 

2.) If paying by Direct Deposit: Client’s must ensure to allow for sufficient time for funds for the total fee of the service to be received into our nominated account by the end of the five (5) business days window for payment. This may mean that the funds for the full fee for the service may need to be deposited into our nominated account up to several days before the expiration of the five (5) business days window for payment. If the full fee is not received into our nominated account by the end of the five (5) business days window for payment for whatever reason, the client will be notified of the situation as soon as possible by Enviro Cleaning Co by either e-mail or phone and given the opportunity to investigate and/or rectify the situation.

 

If the client attempts to investigate and/or rectify the situation (within 24 hours of being notified that funds to cover the full fee for service have not been cleared in our account) and receives confirmation from their financial institution that the problem is as a consequence of a problem at the client’s financial institution’s end, and the client immediately relays this information to Enviro Cleaning Co by either e-mail or phone, Enviro Cleaning Co may then make other arrangements for payment or give further instructions of what to do. In this instance, Enviro Cleaning Co will not cancel the on-going scheduled service.

 

If it is proven that the problem of the full fee not having been received into our nominated account by the end of the five (5) business days window for payment is as a consequence of a problem at Enviro Cleaning Co’s financial institution’s end, Enviro Cleaning Co will make other arrangements for payment or give further instructions of what to do. In this instance, Enviro Cleaning Co will not cancel the on-going scheduled service.  

 

If the full fee for the service is not available in Enviro Cleaning Co’s nominated account by the end of the five (5) business days window for payment, as a result of the client not having allowed sufficient time for the funds to clear in our account, or did not deposit the correct and full amount for the service, then Enviro Cleaning Co reserves the right to cancel the service immediately and without any further notification.

 

3.) If paying by cash: If paying by cash, the total amount on the current invoice is to be paid to an Enviro Cleaning Co team member when they arrive at your premises within the five (5) business days window for payment and prior to the commencement of the next scheduled service after the expiration of the five (5) business days window for payment. A Tax Receipt will be e-mailed to the client within 48 hours of payment. If the client does not have the full amount according to the current invoice, part payment of the service will not be accepted, and Credit Card or Direct Deposit cannot be accepted in this situation. If full payment is not received within the five (5) business days window for payment, and prior to the commencement of the next scheduled service after the expiration of the five (5) business days window for payment, Enviro Cleaning Co will cancel the on-going service immediately and without any further notification. If Enviro Cleaning Co cancels a service due to non-payment after the expiration of the five (5) business days window for payment, a $50 administration/cancellation fee may be charged.

CANCELLING A SERVICE

1.) If you need to cancel a booked-service for whatever reason, Enviro Cleaning Co requires at least 24 hours’ notice by either e-mail or phone.

2.) If you have already paid for your booked-service by Credit Card or by Direct Deposit, AND you have given at least 24 hours’ notice of the cancellation of service, Enviro Cleaning Co will refund the full amount to the account from which the payment was made, within 48 hours of notification of cancellation.

3.) Enviro Cleaning Co will allow two (2) cancellations (made by the client) of a booked-service in a calendar year, where less than 24 hours’ notice of cancellation has been provided to Enviro Cleaning Co, without financial penalty, unless the following condition applies;

i) Enviro Cleaning Co have been notified of a cancellation within one (1) hour of the scheduled service time. In this instance, a $50 call-out fee may be charged to compensate for travel time and fuel and road costs.

4.) Should the same client make more than two (2) cancellations of a booked-service in a calendar year, where they have provided less than 24 hours’ notice, then for each subsequent cancellation (after the first two [2]) the full price of the cancelled service will be due and payable to Enviro Cleaning Co within 5 business days of the cancellation notification, unless both of the following conditions are met (only applies to “One-Off”, “Weekly” and “other cleaning schedules” [apart from daily cleaning services]);

i) The client is willing to re-book another service to the same value and within the same week of the original booking, AND,

ii) Enviro Cleaning Co have enough time to carry out the service within the same week of the original booking without affecting any other bookings in that week.

5.) If you need to cancel a service, Enviro Cleaning Co will try to reschedule the service for another time in the same week as the original scheduled service.

 

LOSS OF AND/OR DAMAGE TO A CLIENT’S BUSINESS OR PERSONAL PROPERTY

Although Enviro Cleaning Co will always take absolute care when cleaning your premises, there may be a time when an accident (incident) occurs involving the inadvertent loss of and or damage to or breakage of the client’s business or personal property which may be directly or indirectly caused by the actions of an Enviro Cleaning Co team member. In this event, the following procedure will take place;

 

If the loss or damage is Proven and/or agreed to be less than $1,500 in value

 

1.) An Enviro Cleaning Co Team Member will take photos of the damaged or broken item as proof of the damage caused.

2.) Without admitting liability until all the facts surrounding the incident have been investigated and clearly established, an Enviro Cleaning Co Team Member will, as soon as is practicable, inform the client (or a representative of the client) either verbally in person, or by phone, or by e-mail (with photos of the damaged item attached) of the incident.

3.) An Enviro Cleaning Co Team Member will then fill out an “An Enviro Cleaning Co Incident Report – Damaged Property” which will outline the details and circumstances of the incident. This report will be witnessed by a different Enviro Cleaning Co Team Member who was present at the premises at the time of the incident, and the client (or a representative of the client who is not a minor) if physically possible, will be given the opportunity to counter-sign the report if the client (or representative) agrees with the report.

4.) Enviro Cleaning Co reserves the right to have the item independently assessed for its value if deemed necessary by Enviro Cleaning Co (if Enviro Cleaning Co and the client do not agree on the value of the item) before deciding what action to proceed with.

5.) If it is deemed by Enviro Cleaning Co, and agreed to by the client, that the cause of the damage to, or breakage of, or loss of the client’s property was as a consequence of an INDIRECT CAUSE (see definitions above), then Enviro Cleaning Co agrees to pay half (50%) of the cost of repairs to, or replacement of, or of the agreed value (whichever the case may be) of the damaged or broken or lost item.

6.) If it is deemed by Enviro Cleaning Co, and agreed to by the client, that the cause of the damage to, or breakage of, or loss of the client’s property was as a consequence of a DIRECT CAUSE (see definitions above), then Enviro Cleaning Co agrees to pay the TOTAL (100%) cost of repairs to, or replacement of, or of the agreed value (whichever the case may be) of the damaged or broken or lost item.

7.) If it is possible to have the item repaired bringing it back to the condition the item was in prior to the incident in which Enviro Cleaning Co were involved with, and without affecting 

the item’s Form, Fit or Function then Enviro Cleaning Co will have the option of having the item repaired, and in a timely manner, at Enviro Cleaning Co’s expense.

8.) If it is not possible to have the item repaired bringing it back to the condition the item was in prior to the incident in which Enviro Cleaning Co were involved with, and without affecting the item’s Form, Fit or Function then Enviro Cleaning Co will make every effort to replace the item with an identical item (as far as is practicable), in a timely manner.

9.) If, after extensive efforts by Enviro Cleaning Co to locate and source an item that is identical to the item (as far as is practicable) that was damaged or broken or lost in the incident in which Enviro Cleaning Co were involved with, fitting the description cannot be sourced, then Enviro Cleaning Co will give the client the option to accept either;

i) Cash to the agreed value (agreed to between Enviro Cleaning Co and the client) of the item (the percentage [%] paid by Enviro Cleaning Co to be determined by whether the incident was agreed to be either a DIRECT CAUSE, or an INDIRECT CAUSE), OR

ii) An item that is very similar or close in appearance, size, condition, value and other attributes to the damaged, or broken or lost item, the cost of which will be paid by Enviro Cleaning Co (the percentage [%] paid by Enviro Cleaning Co to be determined by whether the incident was agreed to be either a DIRECT CAUSE, or an INDIRECT CAUSE).

10.) If it is the case that Enviro Cleaning Co and the client cannot agree on any aspect of an incident in which Enviro Cleaning Co were involved with, which has resulted in the damage, breakage or loss of a client’s personal property, which prevents the situation from being resolved fairly and in a timely manner, it will be the responsibility of the client to seek other methods of resolution, such as independent mediation, arbitration or legal action, however, in certain situations Enviro Cleaning Co may initiate independent mediation, arbitration or legal action.   

 

If the loss or damage is Proven and/or agreed to be over $1,500 in value

    

1.) An Enviro Cleaning Co Team Member will take photos of the damaged item as proof of the damage caused.

2.) Without admitting liability until all the facts surrounding the incident have been investigated and clearly established, an Enviro Cleaning Co Team Member will, as soon as is practicable, inform the client (or a representative of the client) either verbally in person, or by phone, or by e-mail (with photos of the damaged item attached) of the incident.

3.) An Enviro Cleaning Co Team Member will then fill out an “An Enviro Cleaning Co Incident Report – Damaged Property” which will outline the details and circumstances of the incident. This report will be witnessed by a different Enviro Cleaning Co Team Member who was present at the premises at the time of the incident.

4.) If the value of the item that was damaged, lost or broken (in an incident in which Enviro Cleaning Co were involved with) is agreed on between Enviro Cleaning Co and the client to be in excess of $1,500, then Enviro Cleaning Co may claim against their Insurance Policy to cover the potential cost of replacement or repair (or whatever action Enviro Cleaning Co’s Insurance Company decides to enact).

5.) In the event that Enviro Cleaning Co DOES make an insurance claim for the cost of replacement or repair (or whatever action Enviro Cleaning Co’s Insurance Company decides to enact) as a result of an incident in which Enviro Cleaning Co were involved with, which has resulted in the damage, breakage or loss of a client’s personal property, then Enviro Cleaning Co will be bound by the terms and conditions of its insurance policy and must follow those terms and conditions precisely in order to make a potential successful claim. Any action by Enviro Cleaning Co which deviates in any way from the terms and conditions of its insurance policy could either seriously inhibit and/or prevent Enviro Cleaning Co from making a successful claim. Enviro Cleaning Co will explain at this time what the process is and what needs to be done. If the client does not agree with the process or refuses to co-operate in the process such that the result is that Enviro Cleaning Co cannot abide by or meet its obligations according to its insurance policy, then the client relinquishes any right to compensation from Enviro Cleaning Co and/or its Insurance Company, regardless of whether it is proven that the incident was as a result of a DIRECT CAUSE, or an INDIRECT CAUSE.

6.) If the value of the item that was damaged, lost or broken (in an incident in which Enviro Cleaning Co were involved with) is agreed upon between Enviro Cleaning Co and the client to be in excess of $1,500, BUT the exact (final) value is disputed by Enviro Cleaning Co and Enviro Cleaning Co DOES NOT make a claim against its Insurance Policy, then all points in their entirety from and including Point 4.), up to and including Point 10.) above, under the title “If the loss or damage is Proven and/or agreed to be less than $1,500 in value” will apply from this point on.
